Filing elevator reports in DOB NOW: Safety

Every NYC elevator test and inspection ends with a report in DOB NOW: Safety, the online filing system of the NYC Department of Buildings (DOB). Each filing, who makes it, and when it is due.

The short answer

The performing agency files each report in DOB NOW: Safety. Test reports for Cat 1, Cat 3 and Cat 5 (DOB form ELV3) are due 21 days after the test, and periodic inspection reports 14 days after the inspection. The affirmation of correction (DOB form ELV29) is due 14 days after the defects are fixed. DOB NOW stops accepting a year’s Cat 1 reports after Jan 21 of the next year, and periodic reports after Jan 14.

Rules that affect these filings:

  • Only a Cat 1 can be filed unsatisfactory. Its defects are then fixed and an affirmation of correction (AOC) filed. Unsatisfactory Cat 3 and Cat 5 results are not accepted.
  • Hazardous items aren’t reported on the ELV3. Hazardous and cease-use items are corrected immediately.
  • Private residence elevators don’t file periodic inspection reports. The owner keeps them for six years and shows them to DOB on request.
  • Cat 1 defects can get more time. Owners may request up to two 45-day extensions; see defect deadlines.

Who files, and how owners see it

The performing agency files. Owners, agency directors and inspectors each need an NYC.ID account, the City of New York’s online login, to use DOB NOW: Safety.

  • The owner is linked by email. The owner gives their NYC.ID email to the agency, which enters it on the filing. The filing then appears on the owner’s DOB NOW dashboard. The owner email can’t be changed once the filing is submitted.
  • The maintenance company can see periodic reports. The inspector enters the email address of the maintenance company’s director, who can then view the report.
  • A director can also be the inspector. An agency director or co-director may act as the performing or witnessing inspector on an ELV3, or the inspector on an ELV29.
  • Witnessed tests need the witnessing agency director’s signature. Since 2022 the witnessing inspector no longer signs.

Fees and payment

DOB’s Jan 2022 notice set the filing fee at $30 for a periodic inspection report and $40 for an affirmation of correction. The rule refers to 1 RCNY §101-03 for fees, so check there for current amounts.

  • A filing is accepted only once its fees and any penalties due are paid. If the payment fails, the filing is invalid and the owner can be cited for failure to file.
  • Late penalties are paid when the report is filed.
  • An eCheck can take up to 10 business days to clear. The accepted date is still the filing date.

Late and expired filings

Each test or inspection must fall within its cycle: the calendar year for Cat 1 and periodic inspections, three years for Cat 3 and five years for Cat 5. Its report then has two dates: the 21- or 14-day deadline, and the last day DOB NOW accepts it.

  • Late. Filed after the 21- or 14-day deadline, but by the last day DOB NOW accepts it. The owner pays a monthly late penalty.
  • Expired. Not filed by the last day DOB NOW accepts it. The owner pays the failure-to-file penalty, and a new test and a new report are needed in the current cycle.

A test late in the cycle has little room. A Cat 1 done on Dec 15 is due Jan 5 and expires after Jan 21. Penalty amounts are in NYC elevator fines.

  • DOB NOW public portal. Without logging in, search by any of:
    • address;
    • Building Identification Number (BIN);
    • block and lot;
    • device number.
    Filed reports appear under “Safety: Compliance Filings” on the property profile. AOCs are not shown.
  • NYC Open Data. The DOB NOW Elevator Safety Compliance dataset, updated daily, has each device’s latest Cat 1, Cat 5 and periodic filings.

Common questions

How long do I have to file a Cat 1 report in DOB NOW?

21 days from the date of the test. DOB NOW stops accepting a year’s Cat 1 reports after Jan 21 of the next year.

Is it 21 days or 60 days to file an elevator report in NYC?

21 days for Cat 1, Cat 3 and Cat 5 reports, and 14 days for periodic inspection reports, since Jan 1, 2022. The 60 days on some older DOB pages was the earlier rule.

Who files elevator reports in DOB NOW: Safety?

The performing agency, from its NYC.ID account. The owner gives the agency their NYC.ID email, and then sees the filing on their own DOB NOW dashboard.

How do I check if an elevator report has been filed?
