The tests and inspections the NYC Department of Buildings (DOB) requires for every elevator, when each report is due, and what a missed one costs. Every figure links to its source.

Seven guides to NYC and NYS elevator rules

Who does what

  • Owner. Hires the agencies and pays any penalty.
  • Performing agency. An approved elevator agency, licensed by DOB, that does the test or inspection for the owner. Its director or inspector files the report in DOB NOW: Safety, DOB’s online filing system. For the periodic inspection, it can’t be affiliated with the maintenance company.
  • Witnessing agency. A separate, independent approved agency that watches a category test (Cat 1, Cat 3 or Cat 5). Its director signs the report.

DOB says category tests are witnessed. The ELV3 test report form needs no witness signature for:

  • private residence elevators;
  • conveyors;
  • dumbwaiters;
  • material lifts.

Amounts are for commercial, mixed-use and 3+ unit residential buildings. In 1–2 family homes, a never-filed Cat 1, Cat 3 or Cat 5 report, or an uncorrected defect, costs $1,000. Source: 1 RCNY §103-02 (DOB’s elevator inspection rule) and DOB’s Elevator Compliance page.
